Terms & Conditions

The App is designed to assist users in making approximate measurements using compatible built-in features and hardware of an iPhone, including, where applicable:

• The device camera
• Camera-based measurement capabilities
• Device sensors
• The built-in level/bubble functionality
• Augmented reality and other measurement technologies provided by iOS

The App is intended as a measurement and estimation tool and should not be considered a substitute for professional surveying, engineering, construction, inspection, or other specialized measurement equipment or services.

Measurements produced by the App are estimates and may not always be accurate. Accuracy can be affected by, among other things:

• Lighting conditions
• Camera quality
• Device model and hardware
• Sensor accuracy
• The user's positioning or movement of the device
• The surface, object, or environment being measured
• Software or operating-system limitations
• Environmental conditions
• User input or incorrect use of the App

You are responsible for independently verifying any measurement before relying on it for construction, installation, purchasing materials, safety-critical activities, or any other situation where measurement accuracy is important.

Align Systems does not guarantee that any measurement generated by the App will be accurate, complete, or suitable for a particular purpose.

The App does not provide professional engineering, architectural, surveying, construction, medical, safety, or other professional advice.

You should consult an appropriately qualified professional where accurate measurements or professional judgment are required.

Certain features of the App may require access to your iPhone's camera, sensors, or other built-in device capabilities. These features are used to provide the measurement functionality of the App. You may control access to device permissions through your iPhone's settings.

If you deny required permissions, some features of the App may not function correctly or may be unavailable.

When using the App, you agree to:

• Use the App only for lawful purposes.
• Follow applicable laws and regulations.
• Use reasonable care when operating your iPhone around people, property, traffic, heights, machinery, or other hazards.
• Not rely solely on the App for measurements where an incorrect measurement could cause injury, property damage, financial loss, or other significant harm.
• Not attempt to reverse engineer, modify, distribute, or interfere with the App except where permitted by applicable law.

The App, including its software, design, graphics, text, branding, and other content, is owned by or licensed to Align Systems and is protected by applicable intellectual-property laws.

You are granted a limited, non-exclusive, non-transferable right to use the App for its intended purpose on devices that you own or control, subject to these Terms. No ownership rights are transferred to you.

We may modify, update, suspend, or discontinue all or part of the App at any time. We do not guarantee that the App will always be available, uninterrupted, secure, or free from errors.

The App may also depend on functionality provided by Apple or the iOS operating system. Changes to iOS, device hardware, or Apple's services may affect the functionality or availability of certain App features.

The App may rely on operating-system functionality and technologies provided by Apple, including camera, sensor, augmented-reality, and related iOS capabilities.

Your use of an iPhone and iOS remains subject to Apple's applicable terms, policies, and requirements. Align Systems is not responsible for changes, interruptions, limitations, or failures in third-party technologies or services outside our control.

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available." Align Systems makes no warranties or representations that:

• The App will meet your requirements;
• Measurements will be accurate;
• The App will operate without interruption or errors;
• The App will be compatible with every device or iOS version; or
• The App will be suitable for a particular purpose.

Nothing in these Terms excludes any consumer rights or statutory protections that cannot legally be excluded.

To the maximum extent permitted by applicable law, Align Systems shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from reliance on measurements produced by the App.

This includes, without limitation, losses relating to construction, installation, materials, property damage, business interruption, or other consequences resulting from inaccurate or incorrectly interpreted measurements.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded under applicable law.

You may stop using the App at any time by deleting it from your device.

We may restrict or terminate access to the App where reasonably necessary, including where you materially breach these Terms.

We may update these Terms from time to time. Updated Terms will be made available with the App or through the applicable distribution platform.

Your continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

These Terms shall be governed by the laws applicable to Align Systems' place of establishment, except where mandatory consumer-protection laws provide otherwise.

If you are a consumer, nothing in these Terms is intended to deprive you of mandatory rights or protections available to you under the laws of your country or place of residence.
